Gifts in Wills - frequently asked questions for Individuals

Writing a Will is one of the most personal and significant decisions you’ll ever make.

It’s important to take the time you need and have all the information to help you make up your mind. Here’s a selection of some of the most common questions that we are asked by people considering leaving a gift in their Will to Peninsula Health.

Q. I don’t want my family and friends to miss out, what should I do?
A. We understand that your family and friends come first. All we ask is that once you’ve taken care of your family and friends in your Will, you also consider including a gift to your local hospital, or any of your other favourite charities.

Ask your solicitor the best way of providing for your family AND supporting your favourite charities.

Q. I’m not rich, so how can I afford to include a charitable gift in my Will?
A. It’s a common myth that only the rich, famous or eccentric can leave money to charity in their Wills. This couldn’t be further from the truth.

Thousands of Australians from all walks of life leave gifts to their favourite charities every year. Every gift we receive, no matter how large or small, is important to us. They all add up. Even a small percentage of your estate can make an enormous difference.

Q. What is including a gift in my Will going to cost me?
A. Writing or updating a Will is not as expensive as you might think. Solicitors can provide estimates on request, but the cost will depend on how complex your personal affairs are. You can include a gift to Peninsula Health whenever you next revise or update your Will at no extra cost.

Q. How do I make a gift to Peninsula Health/my local hospital in my Will?
A. If you wish to remember your local hospital in your Will, you can use our suggested wording [link] as a guideline. But, we recommend that you speak to a solicitor or financial advisor to get their advice and make sure your final wishes are reflected in your Will.

When considering leaving a gift in your Will, it’s important to make sure that you look after you family and friends first. Once you’ve care of them, you can then divide whatever is left over to your favourite charities. Often our supporters leave 90% of their estates to be shared amongst their family and friends and then leave instructions to divide the remaining 10% between their chosen charities.

Q. Can I add a gift to Peninsula Health in my existing Will?
A. Yes. If you’ve already written a Will but would like to add a gift to Peninsula Health you can easily do so by adding a codicil – which is a short legal amendment – to your existing Will with the help of your solicitor. Visit the Law Institute of Victoria to find a local solicitor.

Q. How will Peninsula Health use the gift I leave in my Will?
A. A gift in your Will that supports our work in general terms provides us with the greatest flexibility to respond to critical priorities in the future. If you’d like your gift used for something specific, please speak to our Gifts in Wills Team to discuss your options. No matter what you choose, we will honour your wishes and use your very kind gifts as you intended.

Q. I want to leave a gift in my Will to my local hospital. Is that possible?
A. Yes. You can choose to include any ward, service or hospital managed by Peninsula Health in your Will.

Our local hospitals include Frankston Hospital, Rosebud Hospital, Golf Links Road Rehabilitation Centre, Tattersalls Palliative Care Unit, and The Mornington Centre.  These facilities are fully owned and operated by Peninsula Health.

To ensure that your gift is directed to the correct facility, it is important to use our correct legal name and Australian Business Number (Peninsula Health ABN 52 892 860 159).

Frequently asked questions for Solicitors, Advisors and Executors

Q. Who should I contact to discuss matters relating to gifts in Wills?
A. In the first instance you should address all enquiries to our Fundraising Department.

Fundraising Manager
Peninsula Health
PO Box 52
Frankston VIC 3199

Phone: 03 9788 1284
Email: fundraising@phcn.vic.gov.au

Q. What if my client’s family needs come first?
A. Of course it is only right that your clients should think about their families’ needs first when giving you instructions for their Wills. We are all aware of Family Provision legislation and the consequences of this being ignored when preparing Wills.

But many of your clients will also want to help the good causes that they care about or that have been important to them and their families. Peninsula Health has a long history of receiving charitable gifts from local community members. People including a charitable gift often tell us how happy and proud they are to be able to make a meaningful difference in this way.

Q. Will my client know which gift is the most suitable type to include?
A. Your client may not know what type of charitable gifts they can include in their Will. Our research tells us that the word ‘bequest’ is a confusing and often a misunderstood term to many Australians.

Your clients may need your help to understand the different options that are available to them and figure out what type of charitable gift best suits them.

Over the years we have found that many of our supporters feel most comfortable with including a gift of a proportion of their residuary estate. This ensures that their legacy gifts and named individuals are taken care of first and then a share of whatever is left over can be divided amongst their favourite charities. This will also prevent the value of any fixed pecuniary cash gift being eroded over time by inflation.

Q What is Peninsula Health’s correct legal name?
A. As a legal professional you understand the importance of correctly identify the rightful beneficiaries in your clients’ Wills. Wrongly identified charities cause Executors legal headaches and long delays when the time comes to distribute the estate.

Many of our supporters wish to support their local hospital or service – which they can absolutely do. This includes Rosebud Hospital, Frankston Hospital, Gold Links Road Rehabilitation Centre, Palliative Care Unit, and The Mornington Centre.

However, our correct legal name for your purposes is Peninsula Health. Our Australian Business Number (ABN) is 52 892 860 159. Our registered address is 2 Hastings Road, Frankston Vic 3199.

Q. Do you have any suggested wording for including a gift in my client’s Will?
A. Yes, we have a form of word that we recommend that you use when including a gift to Peninsula Health in your client’s Will. Please download the wording [link to PDF].

Q. Can my client include specific instructions about how their gift will be used?
A. Yes, your client can choose a particular ward, service or facility or use for their gift. But, we would encourage your client to be as broad as possible given that our services are varied and constantly evolving because medical treatments and patient care change over time as new knowledge and medical breakthroughs come to light.

The more flexibility we have to apply your client’s gift in the best possible way at the time that we receive it, helps make sure their wishes can be fulfilled and ensures that the gift will not fail in the future.

Including a gift in their Will that supports our work in general terms (for our general purposes) provides us with the greatest flexibility to respond to critical priorities in the future.

Q. Is Peninsula health an endorsed charity with Deductible Gift Recipient (DGR) status?
A. As a public health service, Peninsula Health is endorsed by the Australian Taxation Office (ATO) as an Item 1 deductible gift recipient (DGR). This means Peninsula Health can accept charitable gifts including cash, property, annuities or shares.

Q. How should I direct the distributions of gifts to Peninsula Health?
A. All distributions should be directed to the Fundraising Department.

Cheques should be made payable to Peninsula Health and all correspondence sent to:

Attn: Fundraising Manager
Peninsula Health
PO Box 52
Frankston VIC 3199

If you would prefer to make distributions via EFT directly into our bank account please contact the Gifts in Wills Team on 03 9788 1284.
